Legal Requirements for Marriage in Australia

Just Married

To help you prepare for your marriage, Top Hat Weddings is pleased to provide you with the following guidance on legal requirements for marriage in Australia. (Please note that the following is intended for guidance only and any formal decisions should be based on professional legal advice).

Notice of Intent to Marry

You may lodge your Notice of Intention to Marry in person, by fax or by mail. I must receive the appropriately witnessed original Notice at least one month and one day prior to the wedding day. You can lodge this Notice with me up to 18 months in advance of the wedding.


In normal circumstances you must be at least 18 years of age to marry.

Birth Certificate

If you are Australian born you must show me your birth certificates. If born outside Australia, you are required to show me your birth certificates or passports from your country of birth. When we meet prior to the wedding I must sight your passports or birth certificates.

Previous Marriage

If you have been previously married, you must show me your Decree Absolute or Certificate of Divorce, or a Death Certificate for your previous spouse.


You are required to have two witnesses to your marriage ceremony. I am able to organize witnesses for you if you do not have friends or family in Port Macquarie.

International Spouse

If you are planning to bring your partner into Australia on a Prospective Spouse Visa, I can provide you with the necessary letter for the Immigration Department.
